The Costa Concordia Cruise ship, owned by Genoa-based Costa Cruises, ran aground on a sand bank off the island of Giglio Island Italy on Friday, January 13, 2012. There is a number of complex laws that apply to this disaster, for example international regulations require that each cruise company must have a safety plan, called a safety management system, that details responsibilities in the event of an emergency. According to CNN News, "If the incident is contained, passengers might be allowed to resume their normal activities or be kept away from the damaged part of the ship until a return to port, or they might be required to abandon ship. If there is a fire on board, the captain would sound the general emergency alarm -- seven short blasts followed by one longer blast -- to direct crew members to fight the fire and direct passengers to their specified "muster" stations, where passengers are directed during safety drills to gather in event of emergency. The call to abandon is made by the captain. When the abandon ship signal is made, they have 30 minutes to get everyone off the ship, even though the general emergency could have started a day or hour before. It's not clear to Miami maritime personal injury attorney's why the captain didn't issue a mayday signal to call for outside help soon after the accident. One attorney commented "A captain needs to know your ship and what danger your ship is in," "Tilting and listing is a pretty good sign" of distress. Another drunken driving accident occurred in Westminster, Colorado recently. The at fault driver was charged with vehicular homicide and the crash killed a 21-year-old woman. Viet Quoc Nguyen was charged with vehicular homicide reckless driving, vehicular homicide drunken driving, hit and run and causing a traffic accident without giving aid. Additionally, he was charged with driving while his license was under restraint, failure to give aid and disobeying a red light, according to court documents. Also, Nguyen's license was revoked for an alcohol driving offense. Nguyen may have been behind the wheel of a Porsche Cayenne that ran the red light. The accident was at West 118th Avenue at 3:30 a.m. Saturday. Sadly, Jenna Breen, 21, was killed in the accident. Breen, 21, was reported to be returning from her job as a server at the Fox and Hound restaurant in Westminster, Colorado. As part of our ongoing quest to educate the public I think people should learn a few things . An analysis of the civil legal situation is that if the Porsche driver ran the red light then he would be considered at fault and a claim can be brought against the at fault driver's auto insurance company. The civil complaint could claim a violation of a traffic law which is called negligence per se and a jury would be able to consider that in their decision. Also, this case could include a claim that the at fault driver is responsible for punitive damages, because of the DUI. Therefore, a jury could award more than a typical case as punishment money for the victims family. Also, the case is considered a wrongful death claim, so there would be interesting issues on which family members could bring the claim. There is always a shorter statute of limitations on wrongful death cases, in Colorado it is two years. "I have been writing for for many years in various publications and sites, because I enjoy combining useful information with lifestyle articles. Now, I have my own publication to share with friends and future friends. For now you can only get it by email. " Since, I am a practicing lawyer you will see articles about how the law can be used by ordinary people to make their lives more relaxed and less stressed. However, since I'm not all work I will be writing about other lifestyle topics, including my favorite topics, travel, movies, recreation, interesting people, fashion, photography, news, cars, fine living, food, restaurants, relationships, health and sports and plus other relaxing topics everyone likes to read about. Also, we will have articles written by other authors. I promise it won't be boring. I hate boring.

"On July 16, 2010, a motorcycle accident in Denver involved two critical witness Sanchez and Perez. These witnesses were recognized with a cash reward. They were driving home when they saw the at fault drunk driver Villegas, then 25, crash into Jon Brand,59 and Debbie Pyatock. The accident occurred at the intersection of 70th Avenue and Broadway. The two witnesses did the right thing and went out of their way and followed the car that hit the motorcycle. When the drunk driver backed up and took off from the accident location they followed him. The motorcycle driver Brand died shortly after the accident. Debbie Pyatock the injured victim nominated Sanchez and Perez to receive the Law Tigers reward months later. I wanted to thank these witnesses for what they did. I hope it encourages more people to step up and do the right thing. As a practicing attorney who has handled many hit and run cases and many motorcycle cases, I know that witness are critical to obtaining justice for clients. Many times the accident report contains no witness information, so sometimes there is no way to make a civil claim and get medical bills paid or other costs paid by the at fault driver. In other cases we are able to make a little known Uninsured Motorist claim. In Colorado the law states that if the at fault driver was a "hit and run" driver, then it qualifies as an Uninsured Motorist case and the injured party can sue his own insurance policy for damages. The injured victim can seek a settlement from his own auto policy, because it takes the place of the car that left the scene."

"Today in Denver we read the news about a 23-year-old man who was driving drunk and admitted killing a Community College of Denver professor. The guilty driver Jose Nevarez-Coronado received the maximum sentence on Thursday after he pleaded guilty to vehicular homicide while under the influence. He had prior drunk driving convictions. Professor Yvonne Frye was killed in 2010 when she headed home after grading papers. This was a really sad story and I hope the victims family can recover from this tragedy. I wanted to bring up a legal learning point. In the civil arena we often bring civil actions for cases like this. I've been wanting to explain some unusual personal injury issues of law. A legal analysis would go something like this. The victims family would be able to bring a civil personal injury case against the insurance company for the at fault driver. The case would be called a wrongful death claim. There are a couple of real world limitations that would apply. One would be that the insurance company would only have to pay the insurance policy limits of the person at fault. The second would be that the insurance company would resist the claim. Another interesting aspect would be that since the at fault driver was DUI then he would not be able to hide behind a bankruptcy if a jury awarded more than the policy limit, plus since he was DUI there is potential that he could be sued for punitive damages which are punishment damages beyond the typical economic and non economic damages. This is the kind of thought process a lawyer would go through to decide legal issues. Sometimes it's easier to understand the law when it is applied to the real world,even though the real case facts are sad."
